I’ve been following this and it’s outrageous to say the least. Recently we spoke with our agent/friend who lives in Shanghai. I think he was born and raised there. The interesting thing was his lack of outrage over this most recent lockdown. Mild complaint about it being longer than usual. I think if personal freedom was never a part of life and if you have enough provisions, you just accept it. Perhaps the people screaming from their windows are hungry, mad as hell and not going to take it anymore! Sadly, they don’t have that choice.

while putting my resume on all the major job sites (Indeed, Monster, Glassdoor, Job Seekers, LinkedIn, etc.) I randomly get an email from this company. In the email they say “thanks for your interest in the Project Manager position”. Except I never applied to them. I emailed back and forth just to see what it may be about, and they asked me to start doing paid training……before I ever actually spoke with someone.

I agreed to the training, which entailed them sending PDF docs on their company, as they did not ask for any personal info (bank info, etc.) that they couldn’t have got from my resume. 3 days into being send these random freight industry terms, I looked a bit further into their “company”.

– The domain was just registered 3 weeks ago, out of the Ukraine, not Switzerland which they claimed is the corporate HQ.

– all the addresses are of shared spaces, including the “HQ”. You’d think if you need to inspect cargo for heavy machinery, you wouldn’t do it from a small shared space office.

– the “HR Manager” couldn’t answer basic questions like: how long has the company been in business? (he answered “more than a few years”)

– they have zero web presence. No employees on LinkedIn, no job postings on any job sites, nothing pops up on google. zero.

When I asked the “HR Manager” about this via email, his reply was “We’re a European company, so we’re still making a name for ourselves in the states”. Sure buddy….

that they are protecting jobs when in fact they are losing them. The market growth has hidden the loss, although in recent weeks there
were actual losses in volume year over year. The East Coast and Gulf have not only gained market share, they have gained jobs due to their growth and it will continue for the variety of reasons that you stipulate – but the biggest issue is the shippers distrust of labor and what they went through in the past to recover from labor disruptions. They can no longer have a plan that has the West Coast as the primary source of their cargo from Asia, too risky. And the ocean carriers don’t want to have to pay climbing rail rates and the huge costs for empty repositioning on the rail vs the larger ships transiting the Panama Canal with relatively full ships and the lesser costs for not only the loads in and out, but the empty costs being much lower. The ILWU doesn’t seem to care about these facts, primarily because those there now “have theirs” , what happens 5, 1-, 15, 20 years from now, not their problem.

The data analytics space is still in its infancy in my opinion. If you look at what many companies do their data gathering and analysis is still in its beginning stages and is very patchy and incomplete. Some companies are very data analytics focused but I’ve found that ones that conduct themselves in areas of operation rather than analysis (ie a lumber processing company over a stock broker) tend to have very primitive data analytics giving them a great deal of room to improve and benefit.

There is one more reason importers and exporters should have cargo insurance. Even if your cargo holds limited actual value, the whole of your expenses add up.

There are quite a few instances cargo is not highly valued in itself. Some scrap, raw materials, and earthen products such as minerals or clay, among others, are just not worth a large amount of money. It is also a fact total transport costs can add up to a dollar figure that will get your attention. Depending on the transportation origin and destination the cost of getting your export shipment to the buyer’s port can be a larger amount of money than the cost of the actual freight. When the transport costs and the freight value are added up, it’s not an insignificant number anymore. For this reason it is most often suggested CIF (Cost, Insurance, Freight) + 10% as the formula to use when insuring your shipment. It’s the industry standard for a good reason. If you ship a container to your buyer and it is lost in route while you still own it, you will likely have to ship another container to make good on the shipment that was lost.

as a business. The number of bankruptcies, mergers and acquisitions in the past 45 years is testimony as 75% of those in business then no longer exist. On average, a 3% rate of return; industry losses in 6 out of the last 7 years. Freight rates 50% of what they were 20 years ago.
They have had three opportunities in the last 8 years to take actions to reverse decades of poor financial results: in 2011 they were coming off of a year where the industry made $8. Billion (2010), which was amazing considering that they lost $21. + Billion in 2009. Close to a $30. Billion swing, based on
one issue – manage capacity. They anchored over 600 vessels beginning late in 2009 and throughout 2010. Then 2011, anchors up, overcapacity and
chasing volume and market share. The beginning of 6 consecutive years of losses. Next, in 2016 as Hanjin went out, their considerable cargoes were
spread among the survivors. Rates rose for four months, then capacity was added, rates dropped and another year of losses. Now today. Having made
the mistake of watching fuel prices rise for 18 months and do virtually nothing about it for 14 of those months, they finally remove capacity in major
east-west trades and the spot markets rates jump to profit making levels – but only for spot market cargoes as contract cargoes get no GRI, nor do they pay the fuel surcharges. Still, a significant step in the direction of profitability. After a horrible first half in 2018, they may actually make money in the second half. Then what? Will they take the business model they created during the second half of 2018 and use it in 2019? Take contracted rates up to reasonable levels and implement fuel surcharges for all cargo? Or revert to historical decisions to add capacity, chase volume and market share using price as the catalyst, and return to losses? It’s decision making that makes the difference and for decades it has not been one with stellar financial results. The opposite.

shows FAF + YAS JPY55,200.- Our trade terms is CIF and I trust these chareges shall be born by shipper when it comes to CIF terms.
I am not quite sure if my understanding is correct or not. But at least I have been told by our forwarder that shipper should pay them in case
of CIF terms.

Chinese shipping companies seem to charge Japanese importers on purpose these fees. Appreciate kind advice from somebody.

Speaking from a business process perspective, preparing all the documents and providing all the information required by customs supports or expedites clearing shipments. You can call it Support Clearance, Expedite Clearance, or Prepare Shipment Clearance. But Clear Shipment? No.

FedEX Express defines Clearance the way Management Study Guide does. It makes for a very muddled, unclear, and difficult to communicate process. Clearance documentation and the information they contain are simply inputs into the shipment clearance activity. Looking at clearance any other way makes it impossible to properly diagram and document, especially when those diagrams and documentation will be used to define requirements for software development.

My business schooling taught me that businesses are formed to make money, maximize returns to the
shareholders. Yet the focus of containerized shipping is on capacity and liftings.
Take a closer look at the Alphaliner reports that reflect the capacities as of 2020. The top 4 will be Maersk, MCS and Cosco virtually
the same size,and CMA-CGM. When looking at the Top 10, there is usually a relevancy, but not now and not at the end
of 2020. The #10 carrier will be 1/10th the size of Maersk and the numbers 6-10 carriers combined will have less capacity than
Maersk alone.
What does this mean? A very top heavy industry, with a literal handful of carriers controlling 90% of the global capacity and lift,
the rest relegated to what? Minor entities within Alliances? Niche players? It also points to that while the industry lost money
7 of the last 9 years, a few made money (very few) with Maerk’s totals in that time frame in the multiple of Billions.
For Cosco, profitability is a secondary objective, if it even ranks that high in their top 5 objectives. The $26.5 Billion that the Chinese
government is pouring into them between late 2016 and 2020 is a reflection of their intent, and they will climb to being virtually
tied with MSC and the number two carrier in capacity.
Again, what does this mean? Depends on who you are and what your interests are.

of days and threatened others in a dispute involving supervisory personnel. These agreements are as good as
the intentions to improve productivity – there aren’t any provisions for that either. The longshore labor force has
proven many times, they will walk out whenever they feel like it, agreements, contracts etc mean virtually
nothing.

First, focus on the word “global”, look at the numbers of vessels the carriers have or operate and
see who has the ability, absent Alliances, to be global. Maersk with over 700 when considering the order book and acquisition of Hamburg Sud. MSC
is next with far fewer vessels but enough to be global.
Cosco with the Chinese government pouring $26. Billion between last year and 2020 can be as big as they want. With the recent ordering of 20 vessels they will be the same size as MSC by 2020
ONE, much smaller than you might expect, by 2020 they will be 36% of the size of Maersk. CMA will be 40% larger than ONE, but
CMA is under a heavy debt burden and in my opinion someone who may be bought out or merged.
The top 10 are so top heavy the numbers 7-10 combined will be smaller than Maersk in 2020. The 10th largest will be 1/8th the size of Maersk .
My 3 is likely the same as yours; I don’t see ONE emerging in the top 3 but they will be around. Same with the Koreans, for the same
reason as ONE – market protection. Same can be said for Taiwan. I think European nations are comfortable with the current situation and know that
between Maersk, MSC and CMA if they survive, Europe is market protected.
Maersk and MSC merging? My instinct is to say NO. MSC is a very “family” oriented company in more ways than one. And they are heavily invested
in their cruise line. They have always been a mystery relative to access to capital, but regardless, they have emerged as a huge player and have hedged their bets with terminals and the cruise line. The only thing suggesting a merge with Maersk is the similarity of how Maersk purchased Sea-Land; first a joint service with a true combined operation BUT with a CSX ownership of Sea-Land that had many problems and used Sea-Land as an
excuse as to why the stock price was so volatile. But in the end CSX sold Sea-Land for a virtual song, eventually paying less than $825.Million. What a bargain in today’s world. So is AP Moller trying the same tactic, be in a joint service for several years and then buy the partner? I see huge problems with this happening in several countries, China being first. And MSC is not in the situation CSX was.
Interesting speculation.

First, pricing and rates should be a science with a touch of art, instead it is emotional
reaction to “them” most of the time; or “we need 50 more boxes this week so —-“.. The real objective should
be to maximize revenue, a combination of volume and rate (the art part). The noted $700. rate today from Asia
to the West Coast is just foolish in today’s market, it impacts a high percentage of the carriers lift, even if for a
week or two.
On the other hand, announcing a GRI of between $700. to $1100. per container is a waste of time, energy,
and ink. The only people who gain from it are the data input people into automated rating systems; they insert the increase
and then the next few weeks they make thousands of changes – nnoe of them neutral or higher, all reductions.
Common sense has to start to prevail, we are down to 5 carriers having 63% of the global capacity going up to 68%
in 2020.. Get serious and real and start to make money, not once every 7 years.

Your point on mutual accountability is a good one, so naturally it won’t be done:)
I liken this to the chassis situation in the US. For years the carriers have said “we are not
supplying chassis any longer” – unless you are someone we like, then we can talk. Some to this day
provide them to any/all as part of their “sell”, a value added service.
Also note that similar to the chassis situation, it is being done in selective markets, not globally
and universally. The chassis removal was/is an area by area roll-out, and again, going on for
years, and is not done yet.
I see this the same, it will take years and many, many exceptions as carriers try to differentiate themselves
while being in an Alliance etc.

mergers of the type that the Japanese presented. Some learned attorneys have commented “why did they file it in the first
place?”. The simple answer is/was, out of an abundance of caution.
In my maritime career, which started in March 1972, I’ve seen first 7, then 6 then 5, then 4, then three then ONE Japanese
carrier. In 1972 they were combined very large in the TP trades as well as Asia/Europe, supported by the Japanese Trading Houses
and indirectly by the Japanese government. Times changed, they are in the containerized world three mid-sized
carriers knowing they can’t survive in that mode. As ONE, in two years they will be the 5th largest carrier in the world,
58% smaller than Maersk Line, 42% smaller than MSC at #’s 1 and 2 respectfully.
As part of The Alliance, hooking up with UASC will give them enough big ships, with MOL’s order for them now in
implementation, for a competitive string of vessels for the Asia/Europe market, but is that enough to really make
them competitive in that market – one string?
So more power to them in trying to remain relevant and one day, with fair winds and following seas, profitable.

looks like a global presence? 3. Talk about loosing choices, alternatives, port calls, frequency – try 3 global carriers and lose
just one or two more of the “top 15” and serious deterioration of services occurs.
Your last point, cutting costs to be profitable, they have passed that stage. Yes they should be efficient as possible, that is what the
big ships are all about. But if rates don’t go up then a huge problem remains. In the Transpacific, even with the increased rates in new
Service Contracts, round trip revenues port to port of under $1100./40′ still exists. Empty re-positioning costs are over $1. Billion. Those numbers
can’t be sustained even by the most efficient. The terminal costs alone (on in Asia, off on West Coast, on on West Coast off in Asia) are now
approaching $1000. in some lanes and over $850. in virtually all. When was the last time a shipper paid for Terminal Handling charges?
Lowering costs has pretty much been explored and taken advantage of, and oh yes, fuel prices went up significantly. Shippers complain today of
poor service, have been since the start of slow steaming. They are getting what they pay for, poor to mediocre services for low rates.

The facts are that with the consistent low rates for 6 years we, had the tumultuous 2016 with mergers, acquisitions and a failure of one
line. Shippers complained about services years ago; slow steaming, increased transit times, increasing inventories. Now it is going from
4 Alliances to 3, fewer options, some changes in port calls, less frequency, fewer direct calls. Logically, what can they expect? An industry that
has lost money 6 years in a row totaling in the Billions of dollars, the shippers are getting what they pay for – mediocre to poor services and
fewer carriers to deal with.
Is that the world they want to be in constantly? If the objective is constant low rates they will wind up with very few carriers and choices and services
will not improve without increased rates and a return to profitability for the industry. Until then, a few gains here and there by efficient carriers but
with little or no consideration of the shippers – the shippers have none for the carriers, They want constant low rates AND vastly improved services. Ain’t
going to happen.

Thanks for the great comment, as always, Gary. Opportunity for collusion certainly doesn’t suddenly appear because there are three alliances instead of four. The fear people have of collusion within the alliances isn’t new with the latest reshuffle. I was hearing rumblings of it back when Maersk, MSC, and CMA CGM were planning the P3 Network and it’s only intensified as carriers alliances have grown in dominance. Collusion has certainly existed in the last 6 years, but where we’ve really seen it is in the RO-RO market. That’s where carriers have been found guilty of price fixing several times in the last few years. On the container side, there have been price wars, and, you’re right, if there have been attempts at price fixing there, it has failed miserably. Unless some of the carriers at the top were intentionally pushing freight rates way down to drive out some of the competition. The issue of Alliances ganging up through group negotiation against the tug boat operators (and port operators too) is an issue that the FMC is addressing. I’m with you in that I don’t think eliminating carrier alliances is an option. Right now they seem necessary for the carriers to cut down costs and get back to be profitable.

Start with factual history; the ocean carrier industry had virtual global price fixing authority from governments
around the world for decades, so the FMC “allowing” the limited activities in today’s Agreements is a dramatic
reduction in what was fact for decades.
Why would the ability to collude be enhanced by only three Alliances existing? Four was too may for them to collude?
Back to facts, the last 6 years the container industry has lost Billions, so apparently collusion hasn’t existed, or if it
did, it didn’t work. Can the carriers collude? of course, but the number of Alliances have nothing to do with it.
The complaints today are not from shippers on price fixing, they are from tug operators who fear that the Alliances
will use their combined buying power to drive down and keep prices on tug operations down. A justified fear? maybe,
Is that reason to seek legislation? to do what? eliminate the ability for Alliances to gang up on tug boat operators? or
eliminate Alliances,period? Would either of those actions guarantee there will be no collusion? and folks, wake up, if
you want to see services deteriorate more, more carriers leave the industry, fewer services overall – eliminate Alliances.
How many carriers could be global? – 5 at most and realistically 3. Is that what BCO’s need? .

If the forwarder will be importing the goods on behalf of the client, then all shipment related documents will need to be issued with the forwarder’s name and address.

The forwarder will be able to tell you what documents are required and how they are to be issued.

Your experience is certainly better than the experience described by shippers in articles like the Loadstar one shared. While the research cited on shippers’ losses comes from a trusted source, my second paragraph feels a little hyperbolic in hindsight as you point out this is not every experienced shippers’ experience.

I have to think BCOs have a better time of it than medium to small shippers. While the shipper who commonly experiences rollovers quoted in the article is big enough to be a BCO with 170,000 TEU, the research about money lost by shippers due to carrier unreliability doesn’t appear to be specific to the size of the shippers losing money. It just lumps them all together.

The problem definitely exists in general or there would be no need for a company like the New York Shipping Exchange to exist. But I guess the real viability of the company will be seen with time.

I do like your client’s quote. The arrival of the goods is the absolute most important thing. That’s why professionals like yourself and the team here at UC are successful. We make sure shippers get their imports and exports reliably delivered no matter what challenges the industry faces.

30,000 feus a year globally.
We have put mutually measurable clauses into contracts since 2006 which define the minimum commitment from both sides on a lane
by lane basis, literally week by week (usually in 8 to 12 week segments) with serious enough penalties applying equally to both sides
if they fail to provide the volume or service. In that time frame we have had one major fall down by a carrier who in peak season could not
cover 75 feus a week in a specific lane and we had to find an alternative and did. There have been some skipped sailings but we get two
to four weeks notice and agree to options and solutions before it happens. Anyone who is surprised by their carrier it is because they don’t
have the right relationships – or they are using the wrong carriers. By the way the carrier who “failed” to live up to the lane commitment paid
the shipper $250. per container for the shortfall (and that is same penalty that shipper would have paid for shortfall on volumes) and at the
next years contract talks, we dropped that carrier.
The biggest issue is that BCO’s are virtually unwilling to commit to anything until you get to top level people in the company with a very detailed
rationale as to why it is necessary. They can come up with ten good reasons not to do it, but if there is an open and honest discussion and
trust in what you are doing, it is doable. As my one clients CEO said to me when we discussed the concept “Whenever we meet I will complain
about costs, but if the freight doesn’t get here on time to sell it, you are fired”. Simple and elegant phrasing and we worked exceptionally well together.
The last issue is that carriers have “educated” a generation of logistics management that rates, mqc’s, chassis, free time etc are all on the table at
all times, signing the contracts is just where you start negotiating a few days later, and that is just plain stupid – but most carrier management is just that,
read their financial reports.

Yes, if you shipped EXW or FOB, you could still manage the shipment to your client’s warehouse.
The forwarder or broker could work with your customer directly for customs related issues and fees.

With my current company, we are based in the US, have a factory in China, and our client is in the US. Currently, we do not have Incoterms in place with our client. We have a 3PL and plan from factory door to our clients warehouse. We have been shipping under DDP as we initially pay all the fees associated (freight, tax, duty)because we previously quoted the shipping on the original PO to the client. Our 3PL suggests we should ship either EXW or FOB to maximize our profits.

If we were to ship via EXW or FOB, would we still be able to manage the shipment with our 3PL all the way through until delivery to the clients warehouse? Would our 3PL then just bill the client for the remainder of the fees we are not responsible for?

A Customs Agent is a federal law enforcement officer whose primary responsibility is to protect and secure the U.S. Border.

A freight forwarder is an agent who acts on behalf of shippers to arrange the transportation of goods. Freight forwarders offer customs brokerage services (customs clearance, ISF filing, etc). This can sometimes require them to work with customs agents to resolve customs issues.

Thanks for the question, Dave. That is a great one, and a major issue for the international shipping in general right now. Carriers do not have very good transparency when it comes to their finances or even operations, like when a scheduled sailing is going to be cancelled or delayed or cargo is going to be placed on an alliance partner’s ship. The collapse of Hanjin is creating a demand from shippers for carriers to have a greater level of transparency, especially in terms of finances. Hanjin’s z-score was even worse than other carriers, but what these z-scores reveal is that many carriers are in a dangerous place financially. Many larger shippers are demanding to see financials from carriers before signing big contracts with them. The carriers make the shippers sign confidentiality agreements. Small to medium shippers, who can’t deal directly with the carriers, unfortunately do not have the same options. However, with the demand for transparency shift, big carriers should start getting used to a higher level of transparency because they’re not going to really have much of a choice.

Bringing up the carriers anchoring vessels furthers my point. Doing so, carriers decreased capacity. That made sense in controlling freight rates and decreasing downward pressure on rates. The megaship craze has increased capacity when they should have been controlling it with strategies like anchoring and scrapping vessels.

For Maersk, there was some sense creating bigger ships. They did so with thought and strategy (of course, even Maersk has not been without its struggles either). The rest of the carriers just seem to do whatever Maersk does whether it really makes sense for them or not.

Ships have gotten better in terms of fuel consumption and CO2 emissions because they were forced to by environmental regulations regarding pollution in the international shipping industry.

Cargo tracking is not my biggest focus on ship improvement (although, I do like that for more transparency from carriers, which is certainly lacking) but on things like predictive maintenance technology on ships which could save a lot of money for carriers rather than bigger ships that increase capacity and congestion while pushing freight rates lower.

However, for a long time freight rates have been too low for carriers. They’ve been struggling to be profitable, and in large part, the low freight rates is due to overcapacity. Was the decrease in capacity caused by Hanjin’s receivership really enough to cause the hike in freight rates that carriers charged? I suspect not. Those increases don’t seem to be lasting long term. Still, the carriers do need to increase rates to be profitable. While shippers enjoy low freight rates in the moment, prolonged low freight rates (like what we’ve experienced) could cause enough players to exit the game on the carriers end that competition will drop enough for freight rates to dramatically increase over a much longer period.

Keeping track of containers is NOT a vessel improvement. For every day on the water, containers are 12 days on land, and containers on vessels equal less than 20% of the carriers container fleet. So making sure of where every container on the ships are takes care of less than 20% of keeping track of customers freight.
The vessels of today are intimately “better” than those of ten years ago, even 6 years ago. Fuel consumption has almost be halved by technological advances in engines, and they are far cleaner burning than their counterparts.
Your argument on overcapacity is stating the obvious, except you forget 2010., In 2009 the industry lost $20. Billion due to a great drop in volume (nearly 18%) globally and the concomitant reduction in rates. The response was to anchor over 600 vessels and in doing so, stabilized the rates and eventually raising them and the industry made a profit of $8 Billion – and $28. Billion swing in one year through capacity management. They haven’t
repeated that business model since then and as an industry lost money every year since. But to your point, since 2010 while the industry lost Billions, Maersk Line made nearly $5 Billion. Why, a lot of small ships? Hardly, but better managing their assets and revenue many of which happen to be modern, technologically advanced large container ships deployed in the lengthy Asia/Europe markets.

The “customers” part in this is passive the past few years as carriers just kept offering lower and lower rates, once in a while shippers asked, most of the time the carriers volunteered. However, let’s be realistic about businesses, they constantly try to find a cheaper way of doing things.
If you take a typical large corporation, at the beginning of each year the CEO will send out his Specific Objectives for the year; he sends it to his direct reports who adapt the CEO’s objectives to fit their specific job. I guarantee you that every year the CEO has something in his or her Specific Objectives called cost containment or cost reduction, for sake of argument say it is going to be a 5% reduction of all costs . So the VP’s all put in to
their Specific Objectives, a 5% reduction to their cost stream. Somewhere the Logistics and/or Supply Chain people see this and simply mimic it, they have no choice, their compensation and bonus’s are tied to that. They can pursue those or forego their bonus’s and get a poor review. Which course would you take?

comes down to facts like, where in the stacks of containers on the terminal are they? how many moves to free them up for movement? if
on the vessel, which hatch? which cell? how many moves to reach it or them? One large BCO two days ago paid $11,000. to get 11 containers
out of a terminal; happy to do it? not really, but when confronted with the facts of where the containers were, what it would take to move
other boxes twice to get at them, understood. The problem is that the carriers have priced their services so far below costs that when
a charge relates to costs, customers are shocked. Ask those who deal with the four big railroads in the US what it’s like to deal with so few
who do have profit as a motive for being in business, get your head wrapped around that as in about 5 years ocean shipping will be similar.
Not 4 carriers, but 10, all of whom will have survived the foolishness of the past 5+ years.

The small guy, or new business, will suffer, often their premise to achieve sales based on a rate that allows the product to be sold cannot sustain such sales when market rates return to near normal, in Canada the Alberta high grade hay could only be sold to Japan when the shipper achieved a bucket rate, and the carriers will always give space to the higher revenue cargo.

The process of carrier competition through aggressive rate practices has been around for many years, and we cannot project if multiple bankruptcies will stop this from taking place, in the freight business it’s always been there and always will be as long as a forwarder or carrier wants the business and is prepared to cut profits to get it and damage the competitor.
